Terms of use

§ §1. GENERAL PROVISIONS

1.     This Agreement sets forth the terms and conditions that apply to access and use of internet web site located at www.moneyzoom.com (moneyzoom), owned and operated by Direct Capital Group Sp. z o.o., a company incorporated under the laws of Poland, seated in Warsaw, 00-020, 1 Szpitalna Str., office 11 (DCG)

2.     Any Internet web user accessing moneyzoom is defined as “User” in this Agreement.

3.     By using information, tools, features and functionalities located at moneyzoom (together the “Service”)  User agrees to be bound by the terms and conditions of this Agreement and DCG’s Privacy Policy, whether User is simply browsing moneyzoom site or is registered with the Service.  In order to make full use of the Service, User must read this Agreement and indicate  acceptance during the registration process.

4.     User accepts that Service is provided on an “as is, as available” basis.

5.     User may terminate access to or use of the Service at any time for any reason or for no reason. Such a termination means that this Agreement is automatically terminated with no need for making additional representations.

6.     Use of moneyzoom is free of charge.

§ §2. DESCRIPTION OF THE SERVICE

1.     Moneyzoom is a web based application designed to help better control personal expences.  It consists of  tools enabling User upon registration  to set his budget, to make records of his expences by category and to edit them, to review and to analise history and structure of past expences, as well as offers option to compare with other Users.

2.     Moneyzoom also provides with a mobile version available for iphone to enhance mobility of the platform.  This mobile application can be purchased and downloaded from istore and is fully compatible with Service.

§ §3. REGISTRATION

Service is fully accessible to User upon executing following procedure of the registration by:

1.     clicking button “Create account” on the home page of the Service

2.     filling out the registration form by entering valid email address (login) and password

3.     checking the box to confirm acceptance of the Terms of Use of Service

4.     clicking button “Create”

 The User is given the access to his account after entering a correct login and password to the login form, which the user is setting individually during registration in the Service. In case when a user forgets the login or/ and the password there is a possibility to regain them by filling the password recovery form. The user will receive a reminder by e-mail to the address defined during the registration in the service

§ §4. PRIVACY POLICY

1.     Information on how and what type of data (if any) is held about User can be obtained by clicking here to review privacy policy .

2.     Giving the personal data required during registration to the service is voluntary; however it is necessary to gain a User status.

3.     The Administrator of the Personal Data defined in the registration form of Service shall be DCG with its seat in Poland. The Administrator informs that all User personal data shall be stored in the Administrator’s location/ in Poland.

4.     By filling in the registration form and using Service, the User accepts the following activities: data collecting, processing, keeping, recording, sharing and removing his personal data by the Personal Data Administrator when it is essential for a proper functioning of the Service and for the administrative and statistical purposes. User accepts processing his data (the Act of 29 August1997 on Personal Data Protection, “Journal of Laws of the Republic of Poland” of 1997, No. 133) by DCG for the purpose of promotion, marketing, development of products and companies.

5.     DCG is processing the user’s personal data in a data collection registered at the general inspector of personal data protection pursuant to Article 40 of the Act of 29 August 1997 on Personal Data Protection (that is Journal of Laws of the Republic of Poland of 2002, No. 101, Item 926, as amended).

6.     The User is entitled to access their personal data and to correct them, to actual update or to modify as well as to demand its deletion.

7.     User shall accept the use of Cookies solutions, during connecting with Serice, in all cases on the condition they are used to profile the content or to save the User’s individual settings. The information available due to use of Cookies and then placed on the User’s computer, allows DCG to analyse anonymously a statistical activity of the User while using Service, which contributes to it’s development and optimisation.

§ §5. LIABILITY OF DCG

DCG shall not be liable for:

1.      The consequences of improper use of Service by its Users and in particular its use, which is illegal and contradictory to the provisions of these terms and conditions.

2.      Content placed in the service by Users ( comments, messages at forum, private messages and other).

3.      Loss of User’s login (identifier) or the User’s password, which enabled User to use Services, or for coming into possession (independently on the method of their coming into possession) of the login and password mentioned above by the third parties.

4.      Damage caused by the third parties as a result of their coming into possession of the access password to  Service

5.      Using the information placed in the service by the third parties.

§ §6. RIGHTS AND OBLIGATIONS OF USERS

  1.   By using Service, User declares that he has read and that he accepts these Terms and condtions and is obliged to observe them.
  2. Service is protected by copyright, pursuant to Poland copyright laws, international conventions, and other copyright laws. Subject to the above, User may not modify, copy, distribute, republish or upload any part of the Service in any way unless you obtain the prior written consent of DCG. No intellectual property or other rights shall be transferred to you through your use of Service.

§ §7. MISCELLANEOUS

 
  1. These Terms and conditions shall enter into force from the day of its publication at Service.
  2. These Terms and conditions shall be available to all Users at the website address: http://www.moneyzoom.com/administration/terms_of_use.
  3. DCG reserves the right, at its sole discretion, to change, modify, add or remove any portion of these Terms and condtions, in whole or in part, at any time. The modifications shall enter into force upon publication at Service.
  4. These Terms and conditions contain the entire understanding between User  and DCG with respect of Service and no representation, statement, inducement oral or written, not contained herein shall bind either party.
